“ستارلينك” يهدد السلامة الرقمية ولجنة الاتصالات تُحذّر!

عقد رئيس لجنة الإعلام والاتصالات النيابية، النائب إبراهيم الموسوي، ومقرر اللجنة النائب ياسين ياسين، مؤتمراً صحافياً ظهر اليوم الثلاثاء في المجلس النيابي، تم خلاله مناقشة مشروع ترخيص خدمات شركة “ستارلينك“.

وقال الموسوي: “اجتمعت لجنة الإعلام والاتصالات الأسبوع الماضي، وكان هناك نقاش مستفيض حول موضوع ستارلينك، بحضور وزير الاتصالات وكل المعنيين في قطاع الاتصالات، إضافة إلى ممثلين عن الأجهزة الأمنية وكافة الأقسام، سواء في “أوجيرو” أو “تاتش”. ونتيجة للنقاش، لم نتمكن كـ لجنة اتصالات من الوصول إلى إجابات شافية. وأنا وزميلي المقرر ياسين ياسين نوجه رسالة واضحة بأن هذا الموضوع يُناقش ضمن إطار المصلحة الوطنية، ويجب التوافق بين عدد كبير من أعضاء اللجنة”.

ثم قام النائب ياسين ياسين بقراءة النقاط المتعلقة بالمخالفات، وجاءت التوصيات كالتالي:

أولاً – تسجيل مخالفات قانونية ودستورية جسيمة:

• مخالفة المادة 89 من الدستور اللبناني، لجهة منح حق استغلال مورد طبيعي (الطيف الترددي) دون وجود قانون يسمح بذلك، ما يُعتبر تجاوزًا لصلاحيات مجلس النواب.

• مخالفة قانون الشراء العام رقم 244/2021 من خلال الالتفاف على الأصول الإلزامية لتلزيم المشاريع العامة، وتجاهل وجوب عرض المشروع عبر “بوابة الشراء العام”.

• مخالفة قانون المعاملات الإلكترونية رقم 81/2018 عبر إهمال مبدأ السيادة الرقمية وعدم فرض شرط لتخزين بيانات المستخدمين اللبنانيين داخل لبنان.

• مخالفة قانون الاتصالات رقم 431/2002 من خلال تهميش الهيئة الناظمة للاتصالات، وهي المرجع القانوني المختص بتنظيم القطاع وإصدار التراخيص.

• تجاوز المرسوم الاشتراعي 126/1959 الذي يحصر تقديم خدمات الاتصالات الدولية بالدولة اللبنانية.

ثانيًا – غياب دراسات الجدوى والتقييم:

• غياب دراسة مالية أو تقنية أو قانونية تبرر المشروع أو تبين ملاءمته مقارنة بعروض أخرى.

• غياب تقييم للأثر المحتمل على السوق المحلي، لا سيما على الشركات اللبنانية المزودة لخدمات الإنترنت، وما قد ينجم عن المشروع من أضرار اقتصادية أو منافسة غير متكافئة.

ثالثًا – التوصيات:

• عدم المضي قدمًا في المشروع بصيغته الحالية حتى يتم تصحيح المخالفات القانونية واستكمال المسار الرسمي عبر هيئة الشراء العام.

• الطلب من وزارة الاتصالات إعداد دراسة جدوى شاملة (مالية، تقنية، قانونية) تعرض على الجهات الرقابية المختصة.

• التأكيد على احترام المسار القانوني والمؤسساتي الكامل في جميع ما يتعلق بإبرام العقود أو تنظيم المشاريع في قطاع الاتصالات.

وحذرت اللجنة من أن المشروع بشكله الحالي “ليس خطوة تقنية بريئة، بل مسار خطير يهدد بتفكيك الضوابط السيادية والتنظيمية لقطاع الاتصالات”، داعية إلى “تجميد المقترح فورًا وإعادة التفاوض ضمن إطار قانوني شفاف يشمل جميع الجهات المعنية، تحت مظلة سياسة وطنية شاملة للإنترنت الفضائي”.

وختمت اللجنة بالتأكيد على أن “لبنان بحاجة إلى التطوير التكنولوجي، لكن ليس على حساب أمنه وحقوق شعبه، ولا عبر صفقات تُدار خلف الأبواب المغلقة”.

“Starlink” Threatens Digital Safety, Communications Committee Issues a Warning!

The Chairman of the Parliamentary Media and Telecommunications Committee, MP Ibrahim Al-Mousawi, and the committee’s rapporteur MP Yassine Yassine, held a press conference today, Tuesday, at the Lebanese Parliament, during which they discussed the licensing project for Starlink services.

Al-Mousawi stated: “The Media and Telecommunications Committee met last week, and there was an extensive discussion regarding Starlink, attended by the Minister and all concerned parties in the telecommunications sector, as well as representatives from the security agencies and various departments including Ogero and Touch. After the discussion, as the Telecommunications Committee, we did not reach conclusive answers. My colleague, rapporteur Yassine Yassine, and I are sending a clear message that this topic is being discussed in the national interest, and that there must be consensus among many members of the committee.”

Then, MP Yassine Yassine read the points concerning the violations, and the recommendations were as follows:

First – Major Legal and Constitutional Violations:

• Violation of Article 89 of the Lebanese Constitution by granting the right to exploit a natural resource (radio spectrum) without a law authorizing it, which constitutes a breach of the Parliament’s powers.

• Violation of Public Procurement Law No. 244/2021 by bypassing mandatory procedures for public project tenders and ignoring the requirement to present the project via the Public Procurement Portal.

• Violation of the Electronic Transactions Law No. 81/2018 by neglecting the principle of digital sovereignty and failing to impose a requirement to store Lebanese users' data within Lebanon.

• Violation of Telecommunications Law No. 431/2002 by sidelining the Telecommunications Regulatory Authority, the legal body responsible for regulating the sector and issuing licenses.

• Violation of Decree-Law No. 126/1959, which limits the provision of international telecommunications services to the Lebanese state.

Second – Absence of Feasibility Studies and Evaluation:

• Lack of a financial, technical, or legal study justifying the project or demonstrating its suitability compared to other offers.

• Absence of an evaluation of the potential impact on the local market, particularly on Lebanese internet service providers, and the possible economic harm or unfair competition that could arise from the project.

Third – Recommendations:

• Do not proceed with the project in its current form until legal violations are corrected and the official process is completed through the Public Procurement Authority.

• Request that the Ministry of Telecommunications prepare a comprehensive feasibility study (financial, technical, legal) to be presented to the relevant regulatory authorities.

• Ensure that the full legal and institutional process is respected in all matters related to contracting or organizing projects in the telecommunications sector.

The committee warned that the current form of the project “is not an innocent technical step but a dangerous path that threatens to dismantle the sovereign and regulatory controls of the telecommunications sector.” It called for the “immediate suspension of the proposal and for re-negotiation within a transparent legal framework involving all concerned parties, under the umbrella of a comprehensive national space internet policy.”

The committee concluded by emphasizing that “Lebanon needs technological development, but not at the expense of its security and the rights of its people, nor through deals made behind closed doors.”
